MCS kicks off Condo Act review info sessions

The Ministry of Consumer Services is holding info sessions for the province's Condo Act review over the coming weeks in cities near you.

The first session will be held in Toronto this week.  Deets are below.

Our friends at @WB_Condo tweet that further sessions are planned for September 19 in Mississauga and September 27 in Ottawa.  More dates to come.

When a new Condo Act is prepared, I believe the legislators should accompany it with a Note Book, outlining the purpose of each update to the Act. When this is not done, lawyers, auditors, owners, and directors argue about what the purpose is. It wastes a lot of time and sometimes has to go to court for a Judge to decide. For instance, Section 84(2) about the Common Surplus being used for "future" common expenses, is interpreted differently by many. I believe that the legislators wanted Corps. to use the common surplus to pay for common expenses coming in the very near future. I believe the legislators did this to stop Boards from requesting more Fees from owners when there is a common surplus in the Operating Account (that is left over from previous contributions) But, most Auditors believe "future" means anytime in the future. In my opinion, that is a reckless attitude.
