RE: The top 15 Mistakes New Board Members Make
In Canada, according to the condo act, it is my understanding that the board of directors must be fair to the unit owners, but it's fiduciary duty is to the condo corporation and not the unit owners. Is this correct?
That's right, but the reason is not so much the Condo Act as the judge-made common law of fiduciary duty.
